2.1. The Products presented on this Site are offered for sale to consumers, natural persons of legal age (hereinafter the “Consumers” or the “Consumer”) acting for purposes unrelated to any commercial, artisanal, entrepreneurial or professional activity they may carry out. The Products may not be purchased by natural persons under the age of 18 without the permission and supervision of a parent or guardian. YASSOUA does not deliberately collect personal information on the Site from or about minors. The purchase of the Products offered will only be possible for shipments to the countries indicated on the Site.

2.2. Before confirming and submitting the purchase order, the Consumer must carefully read these Terms of Sale, which can also be viewed and downloaded on the Site and/or via email sent by YASSOUA to the Consumer in accordance with the provisions of Article 3.6 below. The Terms of Sale and the Personal Data Protection Notice (hereinafter the “Personal Data Protection Notice”) constitute the provisions governing the contract between the Consumer and YASSOUA concluded remotely through the use of the Site.

3.1. For each selected Product, the Site displays an image of the Product in question, the unit price, the color, and the sizes. The images are used for illustrative purposes only; YASSOUA cannot, therefore, be held responsible for any inappropriate graphic representation of the Products presented on the Site.

3.2. The Consumer may select the Product/Products of interest, including the corresponding color and size. The Product selected for purchase will be added to the “shopping cart”. It is not possible to select a Product by adding it to the shopping cart and saving the latter to complete the purchase during a later Internet session. If the purchase process is not completed, the contents of the shopping cart will be deleted. The sale process will be deemed concluded when YASSOUA receives, by electronic means, the Order Form, after verifying the accuracy of the data relating to the order.

3.3. To purchase the Products, the Consumer must complete and send to YASSOUA the electronic order form (hereinafter the “Order Form”), following the instructions provided on the Site. The Consumer must add the Product to the “shopping cart” and, after reading and accepting the General Terms and Conditions, the summary of information on the essential characteristics of each Product ordered, the breakdown of delivery costs, the conditions regarding the right of withdrawal (“the Information Note on the Right of Withdrawal”), as well as the Information Note on Personal Data Protection, select the payment method and choose the “buy” option.

3.4. By electronically submitting the Order Form, the Consumer accepts and undertakes to comply with these Terms of Sale in the performance of the contract with YASSOUA. For the purpose of submitting the Order Form to purchase Products on the Site, the Consumer must accept these Terms of Sale.

3.5. If the Consumer needs to correct data entry errors, they must follow the modification procedure indicated on the Site before submitting their Order Form. By submitting the Order Form, the Consumer acknowledges and declares that they have read all the information provided to them during the purchase process and fully accept the General Terms and Conditions, as they are binding once the purchase is concluded.

3.6. At the end of the purchase process, YASSOUA recommends that the Consumer save or print the Terms of Sale, the Information Note on Personal Data Protection, and the Information Note on the Right of Withdrawal. The Consumer will receive an email at the address indicated in the Order Form confirming the order placed, the acceptance of the Information Note on Personal Data Protection as well as the Information Note on the Right of Withdrawal and the Terms of Sale, which the Consumer will receive as an attachment to said email. The Order Form will be archived in YASSOUA’s database located in Paris for at least the time necessary to process the orders and, in any event, within the timeframes and under the conditions provided by law. The Consumer may access their Order Form by viewing the “My Account” section or by contacting Customer Service (hereinafter, “Customer Service”).

3.7. YASSOUA reserves the right to refuse orders placed by buyers it considers unsuitable, with whom there is a dispute regarding a previous order, or for any other legitimate reason, without the need to provide any justification. YASOUA reserves the right to limit or not fulfill orders that, at its sole discretion, appear to have been placed for commercial and/or professional purposes.

8.1. YASSOUA may change or correct these Terms of Sale, the Personal Data Protection Notice, as well as the Products offered on the Site and their prices at any time and without notice. The Consumer is responsible for carefully checking the Terms of Sale and the Personal Data Protection Notice each time they use the Site to make a purchase.

8.2. Occasionally, the Site may contain typographical errors, inaccuracies, or omissions (hereinafter, collectively, “Errors”) regarding the description of the Product, the price, any promotions, offers, and the availability of the Product. YASSOUA reserves the right, at any time and without notice, to correct these Errors, change or update the information, revoke any offer containing these Errors, and cancel any order at any time before shipment, including after an order has been sent and even if the Order Confirmation has been issued and the corresponding amount has been charged to the payment method used at the time of purchase.

8.3. The above changes and/or corrections will only be considered valid for purchase orders placed after the date on which YASSOUA made the change or correction. In particular, the Consumer will be charged the prices shown on the Site at the time the Order Confirmation is issued, provided that the ordered Products are available at that time.

9.1. The Products delivered must be inspected by the Consumer at the time of delivery to ensure that they correspond to the Products ordered.

9.2. Any anomalies observed at the time of delivery (for example, alterations or damage to the packaging, damaged Products, missing items compared to the delivery note, items not conforming to the items ordered, etc.) may be indicated by the Consumer directly to the courier service by writing a signed, handwritten comment on the delivery note. In this case, the Consumer will not be required to accept the Products and may return them directly to the courier service.

9.3. In the event of anomalies (for example, alterations or damage to the packaging, damaged Products, missing items compared to the delivery note, items not conforming to the items ordered, etc.) observed after delivery, the Consumer must inform the courier service as soon as possible at the telephone number indicated in the "Contacts" section of the Site. The courier service will send the package containing the Products ordered to YASSOUA, giving rise to the procedure described in Article 11 below.

10.1. If the Product delivered is different from the Product ordered, the Consumer has the right to request that the delivery be made compliant with the order, or, if the Products ordered have become unavailable in the meantime, to cancel the order. In the latter case, no amount will be charged to the payment method used by the Consumer at the time of purchase for the returned goods. If the purchase amount has already been charged to the payment method used at the time of purchase, the credit corresponding to the purchase amount will be refunded within 30 days.

10.2. The cancellation of the order and requests for the return of Products and refunds relating to a Product purchased on the Site must always be made as follows:

(a) within the time period provided for in Article
10.3, the Consumer must inform YASSOOUA of any returns of goods at the email address indicated in the “Contacts” section of the Site, as requested at the end of the return procedure.

10.4. If the Consumer uses the courier services indicated by YASSOUA to return the Products, shipping will be free. If the Consumer uses a courier service of their choice, the return will be at their expense, and YASSOUA will not be responsible for the possible loss of the Product, shipment to incorrect addresses, or late delivery, as the Consumer assumes all risks associated with the shipment. In this case, the Products must be returned by registered mail to the following address:

10.5. YASSOUA will refund the price of the Product if it is returned unused, unwashed, and in the same condition in which it was received, with all original labels, all its parts, and all accessories. Products belonging to the same order must be returned to us simultaneously in the same shipment. Products must be returned in their original condition and packaging.

10.6. YASSOUA will check whether the returned Products are in their original condition and packaging, as indicated in Article

11.4. If all the aforementioned conditions are met, YASSOUA will refund the value of the order as soon as possible, and in any event within 30 days of receipt of the return form. The Consumer must sign the courier service’s pickup receipt and keep it; it is very important to keep the receipt to be entitled to request a replacement. The shipping costs for the Product are borne by Yassoua.

11.1 The Products offered for sale on the Site are provided “as available.” YASSOUA  makes no warranties, express or implied, beyond the description of the Products in the Order Confirmation; in particular, Yassoua Paris makes no express or implied warranty (i) regarding the operation or content of the Site, (ii) regarding the absence of viruses on the Site and the servers hosting it, or in emails, or (iii) that the information collected on the Site will be completely protected against access by hackers and other unauthorized users.

YASSOUA  expressly disclaims any obligation to update or review the materials on the Site. The Consumer assumes full responsibility for any risks associated with the use of the Site.

12.1. YASSOUA is responsible for any defect in the YASSOUA brand Products offered on the Site, including the non-conformity of the ordered Products with the provisions of French law and the Consumer Code (Legislative Decree No. 206 of September 6, 2005, and subsequent amendments, pursuant to the corresponding Community Directives and, in particular, the principles and procedures provided for by European Directive 1999/44/EC).

12.2. The Product warranty provided by YASSOUA is valid provided that the two conditions indicated below are met:

a) the defect must manifest within fourteen (14) days from the date of delivery of the Products;

b) the Consumer must submit the formal complaint regarding the defects within a maximum period of two (2) DAYS from the date on which the defect was identified. In particular, pursuant to the provisions of Article 130 of the Consumer Code, in the event of non-conformity, the customer shall be entitled to obtain the conformity of the products, free of charge, by means of repair or replacement, or to obtain an appropriate price reduction, or even the termination of the contract relating to the disputed products.

In particular, under Article 130 of the Consumer Code, in the event of non-conformity, the Consumer shall have the right to obtain, free of charge, the repair or replacement of the non-conforming Product, or to obtain an appropriate price reduction, or the termination of the contract relating to the Products subject to the complaint.

12.3. Complaints must be submitted by email sent to the address indicated in the "Contacts" section of the Site.

12.4 The costs of returning defective Products will be borne by YASSOUA.

12.5 In no event, including negligence, shall Yassoua be liable for any damages whatsoever, including, by way of example only, direct, indirect, incidental, or consequential damages, arising directly or indirectly from the use or inability to use the Site; reliance on information appearing on the Site or errors, service interruptions, deletion, degradation, or corruption of files or emails, software errors, viruses or defects, delays in operation or transmission, failure to communicate, theft, destruction, or unauthorized access to Yassoua's data, programs, or services.

12.6 YASSOUA shall not be liable for any delay or failure to perform caused by circumstances beyond its reasonable control.
